Tree Surgeons Stokenewington Service Terms and Conditions
These Terms and Conditions set out the basis on which Tree Surgeons Stokenewington provides arboricultural services to domestic, commercial, and managed property clients. By booking or accepting a quotation, the customer agrees to these terms, which are designed to ensure clarity, safety, and fairness for both parties. The wording below applies to all work arranged under the name tree surgeons Stokenewington, including tree pruning, crown reduction, tree removal, stump-related work, hedge management, and associated site clearance services.
For the purposes of these terms, “we”, “us”, and “our” refer to the service provider operating as Stokenewington tree surgeons, and “you” or “the customer” refers to the individual, company, landlord, managing agent, or other entity requesting the services. These terms should be read alongside any written quotation, job specification, risk assessment, or work schedule supplied before the job begins. If any detail in a quotation conflicts with these terms, the quotation will take priority for that specific instruction only.
1. Booking process
All bookings are confirmed only after we have received sufficient information about the site and the requested works. This may include tree species, height, access conditions, known hazards, and whether the tree is near structures, roads, footpaths, or utility services. We may request photographs, site measurements, or a pre-work inspection before providing a final quotation. An initial estimate does not bind us to undertake work until the site has been assessed and the scope is confirmed.
Once a quotation has been accepted, we will agree an indicative date or time window for the work. While we will make reasonable efforts to attend on the agreed date, appointments may be affected by weather, traffic, equipment failure, staff availability, or safety considerations. As with many tree surgery Stokenewington services, final access and safety checks are carried out on arrival, and we reserve the right to reschedule if conditions are not suitable for safe operation.
It is the customer’s responsibility to ensure that the site is ready for the works to begin. This includes providing safe access, securing permission from any relevant third parties, and informing us in advance of any concealed risks. If a permit, parking suspension, neighbour approval, freeholder consent, or local authority permission is required, the customer must arrange this unless we have expressly agreed in writing to do so. Delays caused by incomplete access arrangements may result in postponement fees or additional charges.
2. Scope of services
Our work is carried out in accordance with reasonable arboricultural practice and in line with the agreed specification. Unless stated otherwise, quotations cover only the services described in writing. Additional work requested on the day, such as extra branch removal, emergency access adjustments, or removal of unexpected obstructions, will be priced separately and must be approved before proceeding where practical. Any change to the scope may affect the timing, method, and price of the project.
If during the job we identify hidden defects such as decay, instability, cavities, or prior storm damage, we may pause the work and advise you of the likely implications. In some cases, the safest course may require a revised method or a partial cancellation of the original plan. We are not obliged to continue with work that we reasonably believe would create a danger to operatives, property, or the public. This is particularly important in professional Stokenewington tree surgeons work where trees may be structurally compromised.
3. Payments
Payment terms will be set out in the quotation or invoice. Unless agreed otherwise in writing, full payment becomes due on completion of the work, or on receipt of the invoice where invoicing is used. We may request a deposit for larger, scheduled, or specialist jobs, and such deposits are generally non-refundable except where we cancel the work without reasonable cause. Accepted payment methods may include bank transfer, debit card, credit card, or other methods stated in the invoice.
All prices are quoted in pounds sterling and may be subject to VAT where applicable. Quotes are based on the information available at the time and may be revised if site conditions, scope, or disposal requirements differ materially from what was described. If payment is not made by the stated due date, we reserve the right to charge statutory interest and recovery costs in line with UK late payment legislation, and to suspend any further services until the account is settled.
4. Cancellations and postponements
You may cancel or reschedule a booking by giving us reasonable notice. For standard bookings, more than 48 hours’ notice will normally avoid cancellation charges, though any non-recoverable costs already incurred may still be charged. If cancellation occurs after materials have been ordered, specialist equipment has been hired, or a team has been allocated specifically to your job, we may retain a proportion of any deposit or invoice the wasted costs.
Where the customer cancels on arrival, refuses access, or is not present when attendance is required and the job cannot reasonably proceed, a call-out or cancellation fee may be payable. We may also postpone a job due to adverse weather, unsafe ground conditions, high winds, poor visibility, or any other factor that makes tree work unsafe. In such circumstances, we will aim to rearrange the appointment within a reasonable period, but we are not liable for indirect losses caused by delay.
5. Liability and limitations
We will take reasonable care and use appropriate professional methods to deliver the agreed services. However, tree work involves natural variability and inherent risks, and outcomes cannot always be guaranteed in the same way as manufactured goods. Trees are living organisms and may respond unpredictably to pruning, crown thinning, or reduction. We are not responsible for natural movement, hidden defects, pre-existing disease, subsurface root issues, or failures arising from conditions that could not reasonably have been identified before work began.
Nothing in these Terms and Conditions limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot lawfully be excluded under UK law. Subject to that, our total liability for any claim arising from our services will be limited to the amount paid for the specific work giving rise to the claim. We will not be liable for indirect or consequential losses, including loss of profit, loss of opportunity, or inconvenience, unless required by law.
We are not liable for damage caused by defective structures, unstable ground, concealed utilities, brittle masonry, or items left within the work zone where the customer failed to remove them or warn us about them. If you request that we work close to buildings, fences, conservatories, paving, or other fragile features, you accept that a degree of risk remains even when reasonable precautions are taken. Any special protection measures must be agreed in advance and may incur extra charges.
6. Waste handling and regulations
All arisings removed from the site, such as branches, logs, woodchip, leaves, and stump waste, will be handled in accordance with applicable waste regulations. Unless otherwise agreed in writing, waste generated by the works becomes our responsibility once it has been loaded for transport. We may recycle, reuse, compost, or dispose of arisings through lawful routes and approved facilities. We do not permit uncontrolled burning or illegal dumping of green waste.
Where the customer wishes to retain timber, woodchip, or other arisings, this must be requested before the work starts and must be practicable within the site conditions and vehicle capacity. Retained materials are left at the customer’s risk once placed in the agreed location. We are not responsible for further cutting, stacking, seasoning, or relocation unless this has been expressly included in the quotation. If contaminated, diseased, or invasive material is present, separate handling requirements may apply.
We will comply with relevant UK environmental and waste transfer obligations, including the duty to ensure that waste is transferred to authorised persons or facilities. Any paperwork required for commercial waste movements, where applicable, will be issued or retained in line with legal requirements. The customer must not ask us to leave waste in a manner that would breach environmental law, local restrictions, or property management rules. If the customer insists on an unlawful method, we may refuse the instruction and revise the quotation accordingly.
7. Customer responsibilities
The customer must provide accurate information about the property, the trees, and any known hazards. This includes underground services, overhead cables, fragile surfaces, concealed drains, rights of way, nesting birds, and protected species considerations. If the customer is not the legal owner, they must obtain all necessary permissions before work begins. By instructing us, the customer confirms that they have authority to request the services and accept these terms on behalf of all relevant parties.
The customer must also remove or secure items that could be damaged by falling debris or moving equipment, such as garden furniture, ornaments, vehicles, and loose materials. Pets and children must be kept away from the working area during the job. We may stop work if the area is not made safe or if conditions change in a way that increases risk. Any delay caused by the customer’s failure to meet these responsibilities may be charged at our standard waiting or attendance rate.
8. Access, property, and site conditions
Reasonable access must be available for our team, vehicles, and equipment. If machinery cannot be brought close enough to the work area due to narrow access, parking restrictions, poor ground conditions, or obstructions, additional labour or manual handling charges may apply. We will not be responsible for damage caused by pre-existing weak surfaces, concealed defects, or access routes that were not disclosed in advance. Any instruction to use a particular access route is taken at the customer’s risk unless we have agreed otherwise in writing.
We will take reasonable steps to protect lawns, paths, and surrounding structures, but some disturbance is unavoidable in tree work. Weather, soil saturation, and heavy equipment may affect ground surfaces. Where appropriate, we may use boards, mats, or alternative methods to reduce impact, but we cannot guarantee a damage-free result in all circumstances. After completion, any reasonable make-safe or tidy-up tasks included in the quotation will be completed, though restoration beyond normal site clearance is excluded unless expressly agreed.
9. Complaints and rectification
If you believe the services were not delivered in accordance with the agreed specification, you must notify us within a reasonable time after completion and provide enough detail for us to assess the issue. We may request photographs, access to the site, or further information. Where a defect is found to be attributable to our workmanship and is reasonably capable of rectification, we will normally be given the opportunity to inspect and remedy the matter before any third-party intervention.
10. Governing law
These Terms and Conditions, and any dispute or claim arising from them, are governed by the laws of England and Wales. The parties agree that the courts of England and Wales will have exclusive jurisdiction over any legal proceedings, unless mandatory consumer law provides otherwise. If any provision of these terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect. No waiver of any right will be effective unless made in writing.
By proceeding with a booking, you acknowledge that you have read, understood, and accepted these Terms and Conditions for tree surgeons Stokenewington services. They are intended to provide a clear framework for safe, professional work and fair payment, while recognising the practical realities of arboricultural services. We reserve the right to update these terms from time to time, and the version in force at the time of booking will apply to your service unless otherwise agreed in writing.
